By accessing or using our website, products, and services (the “Services”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Services.

1) Eligibility & Your Account

You must be 18 years or older (or the age of majority where you live) to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2) Online Store & Orders

We sell products and/or services through our online store hosted by Shopify. We may limit or cancel quantities per person, household, or order. If we change or cancel an order, we may attempt to notify you via the email, phone, and/or billing address provided at purchase.

3) Pricing, Payments, Taxes

Prices are shown in U.S. dollars unless stated otherwise and may change without notice. You authorize us and our payment processors to charge your selected payment method for all purchases, including applicable taxes, shipping, and fees.

4) Shipping, Returns, Refunds

Any shipping, delivery, return, or refund terms published on our website form part of these Terms. Please review those policies before purchase.

5) Acceptable Use

You agree not to misuse the Services, including by: (a) violating any law; (b) infringing intellectual property; (c) transmitting malware or harmful code; (d) scraping or crawling without permission; (e) attempting to access another user’s account; or (f) interfering with the security or integrity of the Services. We may suspend or terminate access for violations.

6) User Content & Feedback

If you submit reviews, comments, media, or other content (“User Content”), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, translate, distribute, and display such content in connection with the Services and our marketing. You represent that you own or have permission to use and license such content and that it does not violate the rights of others.

7) Third-Party Services & Links

The Services may link to third-party sites or integrate third-party tools. We are not responsible for third-party content, products, or practices. Use third-party services at your own risk and review their terms and policies.

8) Intellectual Property

All content on the Services (including text, graphics, logos, icons, images, audio, video, software, and designs) is owned by or licensed to IAMBulldog and is protected by applicable laws. Except as expressly allowed, you may not use, copy, or distribute content without our prior written permission.

9) Marketing Communications & Electronic Notices

By creating an account, making a purchase, or otherwise providing your contact information, you agree we may send you service-related and transactional communications. Marketing emails will include an unsubscribe option. See Section 12 (Privacy) for how we handle your information.

10) SMS/Text Messaging Terms (A2P 10DLC)

By opting in to receive text messages from IAMBulldog, you agree that we may send recurring SMS/MMS messages to the mobile number you provide. These may include order/appointment updates, reminders, customer support notices, and promotional messages. Message frequency varies. Message & data rates may apply. Consent is not a condition of purchase.

Opt-In Methods. You may opt in via website forms, checkout, texting a published keyword, or by otherwise requesting SMS from us.

Opt-Out & Help. Reply STOP to any message to cancel. You may receive one additional message confirming your opt-out. For help, reply HELP or email lyric@thrivercreative.com.

Eligibility. The messaging program is intended for U.S. residents aged 18+ (or the age of majority in your state).

Data & Privacy. We collect your mobile number, opt-in/opt-out status, message content, timestamps, delivery information, and related technical metadata to operate the program and comply with law. See our Privacy Policy for details.

Carriers. Wireless carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice.

We may modify or terminate the messaging program at any time. Updates will be posted in these Terms or provided by SMS.

11) Disclaimers

THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free.

12) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IAMBulldog AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL; ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT OR SERVICE AT ISSUE IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow certain limitations; in such cases, the above limitations apply to the maximum extent permitted by law.

13) Indemnification

You agree to indemnify, defend, and hold harmless IAMBulldog and our affiliates, officers, directors, employees, agents, and suppliers from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Services.

14) Privacy

Your use of the Services is also governed by our Privacy Policy (effective October 7, 2025), which explains how we collect, use, and share information, including the SMS clause. Please review it carefully.

15) Suspension & Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you violated these Terms or applicable laws. Sections that by their nature should survive (e.g., IP, Disclaimers, Limitation of Liability, Indemnification, Governing Law, Disputes) will survive termination.

16) Governing Law; Disputes

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Texas for any dispute that is not subject to arbitration (if applicable). You and we agree to bring claims only in an individual capacity, not as a class representative or class member.

(If you want binding arbitration and class-action waiver, tell me and I’ll add a compliant clause.)

17) Changes to the Services or Terms

We may update the Services and these Terms from time to time. The “Effective Date” above reflects the latest version. Your continued use of the Services after changes are posted constitutes acceptance.
